What is a Personal Injury claim?

Personal Injury is a type of law that provides a remedy to those who have suffered pain and serious injury as a result of an unforeseen incident (e.g. automobile accidents, tractor trailer accidents).

How do I know if I have a claim?

In determining if you have a personal injury claim ask yourself 3 questions:

  1. Was I involved in an accident?;
  2. Was it the other person's fault?;
  3. Do I now have pain and bodily injury?
If the answer was "yes" to all 3 of the questions, then you DO have a claim!

When do I need to call a lawyer?

Whether it is after your hospital visit, as you begin medical treatment, or even after you have called 9-1-1 following the accident; a lawyer should be one of your first few calls.

How does the insurance adjuster value my claim?

The insurance companies value a personal injury claim based on type of bodily injury, number/frequency of medical visits, total cost of medical bills, lost wages, and medical history. The insurance companies are very stingy, they want to offer you as little money as you will accept. Thus, our job is to make sure that you get the amount you deserve.

How long does the process take?

There is no specific amount of time it takes to resolve a personal injury claim. With that being said, the amount of time it takes for the client to receive adequate medical attention and treatment plays a large role. It is our sincerest advice that clients do not rush treatment in hopes of receiving payment on the claim. Because we do not start negotiating until after the client has completed treatment the entire process can take a few months. However, it is our goal to resolve claims as fast as possible so that our clients can move on with their lives.

How does the process work?

A personal injury claim is a unique area of law. A typical claim is resolved without ever filing a lawsuit. Personal injury is between you, the injured party, and the insurance company of the person who hit you. Generally, the injured person begins medical treatment with all providers necessary (e.g. surgeon, physician, chiropractor, etc.). During this time we will begin preparing your file, receiving medical bills, and contacting insurance companies.

However, the real battle begins after you have completed treatment. At that point we will begin negotiating with the insurance company on the offer they will make on your claim. Our goal is to get our clients the most money we can.
